Summary/Abstract: The safeguarding of the best interests of the child inevitably continues to be confronted with the different dynamics of religious pluralism that affect contemporary society and that appear to imply ‘new’ ways of conceiving the minor’s rights to fundamental freedoms. All of this has, moreover, led to the emergence of further needs to protect the full development of the child in respect of his specific identity in the various social spheres of public space, also with reference to family relations, which - as is well known - constitute one of the most specific and sensitive components of the various religious traditions, as well as the primary place in which every culture is practiced and transmitted. Greater problems seem to emerge, for example, in cases where there is no agreement between parents on important choices in their child’s education, such as the decision on which school to attend, whether secular or religiously inspired. Such cases highlight, in fact, the complexity of balancing the child’s fundamental rights - such as the right to ‘healthy and balanced growth’ - and the parents’ right-duty to an education that doesn’t conflict with their own innermost convictions, including those of a religious nature.
