Registration of civil status by municipalities – selected problems

Summary/Abstract: The article presents selected problems related to the performance of civil statusregistration by municipalities. First, the concept of civil status registration is explainedand the legal forms in which it is performed are indicated. The authority of these formsdetermines the inclusion of civil status registration in the sphere of regulation andorder administration. However, its classification by the legislator as tasks entrustedto municipalities in the field of government administration determines the method offinancing the task and results in the fact that the role of municipalities in performingthe task is reduced to executive functions. Moreover, the article discusses selectedcurrent problems related to the organization and financing of the performance of thetask by municipalities, including qualification requirements and ensuring appropriatestaffing in registry offices, as well as difficulties related to pursuing monetary claimsby municipalities in the event of underfinancing of the task implementation by thegovernment administration.
