Summary/Abstract: In this paper a case of homicide of a free person has been analysed, in which case the roman law prescribed, beside the punishment of exile (for crime), paying of a certain sum of money to the father of the deceased person as a compensation for material damages caused by killing (for tort). The author is trying to find answers on questions, by which action the perpetrator is liable for tort, and by which criteria the sum of money to be paid has been calculated.
