The role of territorial self-government in the sphere of counteracting drug addiction

Summary/Abstract: For the first time the issues of drug addiction were regulated in a comprehensive way in Poland in the Act of 31 February 1985. According to this Act, counteracting drug addiction was assigned to the state, especially to the organs of state administration. It was a natural consequence of both importance of these problems and a monistic system of local administration (based solely on the organs of state administration). However, reactivation of the territorial self-government in Poland in 1990 on the gmina (commune) level and also the creation of the further levels of self-government as the effects of reform from 1998, stressed the necessity of defining the role of state in a new way, and the need to indicate the place of territorial self-government in counteracting drug addiction. In 1990 the gmina self-government was easily included in the activity of counteracting drug addiction through the various tasks from the social sphere comprising e.g. social help tasks addressed to the addicted and their families, informing, educational and training activities (as the proper tasks of gmina) and rationing tasks (as the commissioned tasks in the field of governmental administration). There is a different situation in case of including poviat and regional self-government in the range of units of territorial self-government performing tasks in the sphere of counteracting drug addiction. The Act of 2005 on Counteracting Drug Addiction does not provide for poviats tasks in this sphere although there are the needs and possibilities in these fields. When it comes to the role of regional self-government, it was only assigned to perform the tasks of counteracting drug addiction in the social sphere. Performing rationing tasks assigned to regional self-government in 1999 was again – under the Act of 2005 – passed on to voivods.
