OBLIGATION TO SUBMIT ASSET DECLARATIONS BY LOCAL GOVERNMENT EMPLOYEES, HEADS OF ORGANIZATIONAL UNITS AND MANAGERS OF LOCAL GOVERNMENT LEGAL ENTITIES

Summary/Abstract: The obligation to submit asset declarations by offi cials, persons managing local government organizational units and local government legal entities is specifi ed in Polish law in several legal acts. Despite the apparent uniformity of this solution, there are signifi cant legal diff erences between them, which means that calling a local government employee to submit a declaration of assets under Art. 32 of the Act on local government employees is practically pointless. Only obligatory annual asset declarations pursuant to local government acts may constitute a real manifestation of anti-corruption activities due to the fact that they are subject to multi-track verifi cation. The aim of the article is to discuss the institution of asset declarations. The hypothesis of the article is the ineff ectiveness of the institution of declarations under Art. 32 of the Act on local government offi ces as an anti-corruption solution. The research methods adopted include exegesis of legal provisions, analysis of collected literature and case law.
