Summary/Abstract: Global climate change is a „tragedy of the commons”. The most pressing commons problem at the global level is the need to reduce greenhouse gas concentrations substantially. In this paper I applied the theoretical approach developed by Elinor Ostrom, in her work, Doing Institutional Analysis. Digging Deeper than Markets and Hierarchies, as a framework for an institutional analysis. I identified three levels of institutional analysis – constitutional level – The Kyoto Protocol , collective level – European Union’s Emissions Trading Scheme, and operational level- a brief case study for Romania. My goal is to show how rules operating at one level ‘nest’ into the superior level rules, in order to form a coherent solution for governing the common pool resource.
