Polemic on the Obligatory Defence of the Defendant in Polish Criminal Proceedings

Summary/Abstract: The text attempts to present some controversies related to the institution of obligatory defence. The basic assumptions underlying this defence, the sources of obligatory defence are presented, and attention is drawn to the lack of distinction between optional and obligatory defence in some international conventions, to which Poland is a party. The text points out certain deficiencies in the regulation of obligatory defence and proposes amendments to the provisions. It is a polemical publication.v
