ON PROBLEMS OF CURRENT SAFEGUARDING PROCEDURES CARRIED OUT ON THE MAIN DRILLING IN CRIMINAL MATTERS

Summary/Abstract: Annulment of the hearing connected with necessity of conducting evidence activities during it is the subject of this article. The importance of principle of open proceedings for the rightful and reliable proceeding in criminal case was discussed. The arguments of taking individual decision about making the trial or its parts confidential related to interests of the parties, mystery or fear of disclosure of shameful information were showed. The subject of analysis are the issues included in the Polish Code of Criminal Procedure as well as these in the Act on the Crown Witness.
