THE EFFECT OF ELECTRONIC SURVEILLANCE MEASURES ON REDUCE OVERPULATION IN PENITARY FACILITIES

Summary/Abstract: The aim of the publication is an attempt to assess the validity and application of the electronic surveillance system (SDE) in Poland and to indicate its potential advantages and disadvantages, including the actual impact on reducing overcrowding in penitentiary units. In the first part, the electronic supervision system was characterized in the context of existing technical solutions and the historical outline of the institution was indicated, i.e., the history of the development of this system in the world and the source of its origin. In the following part, legal regulations concerning SDE in the Polish legal system are presented based on existing legal acts, considering European standards. Further issues are described in the aspect of overcrowding in Polish prisons, which is one of the main reasons for the introduction and further development of the electronic supervision system in the country. Overcrowding in the prison system and its effects have a negative impact on the implementation of the state's penal policy, including the effective execution of the penalty of imprisonment. The conducted arguments became the basis for answering the main question regarding the real impact of EMS on solving the problem of overcrowding in prisons and the main advantages of its use. In the final part of the article, general data on the number of people incarcerated in prisons over the past years and on the total number of prisoners who were subject to ESS were also quoted. The summary indicates the positive aspect of the adopted legal solutions with some reservations and the need for their further extension towards other prisoners. This process should lead not only to reducing overcrowding in prisons, but above all to reducing the costs of serving a sentence of imprisonment in prison conditions and counteracting social exclusion of convicts after serving their sentence, proper treatment of prisoners, maintaining family and social ties and reducing tension in detention centers.
