Summary/Abstract: Each EU Member State should in its legal systems guarantee to the extent necessary to achieve the objectives of criminal proceedings, adequate protection for the rights of victims and witnesses while respecting their dignity and ensuring protection against secondary victimization. However, the practice of applying legal solutions adopted in Poland in this respect in the absence of appropriate cooperation between the authorities raises doubts. It is worth looking at the Act On protection and help for the victim and witness of 28 November 2014 to indicate its legal shortcomings, assess the application of legal solutions adopted in practice, pay attention to interpretation doubts. The Act plays an important role in shaping the appropriate level of protection for the victim and the witness, while at the same time quite deeply interferes in the sphere of parental rights of both parents This should not escape the attention of the protection authority and the procedural authority, which are responsible for cooperation with other law enforcement authorities for the benefit of the family and minors.
