Principles and basic functions of legal-financial instruments for environmental protection

Summary/Abstract: In the process of developing the legal framework intended to counteract any negative phenomena, it is necessary, first of all, to lay the foundation for certain operating principles, but it is also required to identify certain functions that the elaborated rules are to fulfill. It is also the case of the principles of operation of the economic-financial instruments of environmental protection which, according to their type, are specific and manifest a certain financial impact on those who obtain financial resources based on the exploitation of environmental components. Therefore, the financial burden of restoring the environment affected by economic activities is to be imposed with great caution and fairness on the economic operators, taking into account the general principles in the matter of environmental protection, but also the requirements of the legislation in the economic field, with a preponderance of the commercial one.
