Tort litigation - symbiosis between common law and administrative litigation

Summary/Abstract: This study aims to analyze certain particularities of the contravention, an institution that we place on the border between administrative law and criminal law, in terms of content and between civil procedure, criminal procedure and that of administrative litigation, in procedural aspect. The presentation goes through aspects of normative evolution, the constitutional and legal framework and some elements that it discusses that we have identified in practice and which represent, in our opinion, a distortion of the regime of this institution. In this context, we also formulate proposals on how the jurisprudential approach and administrative practice should change over time.
