Selected issues connected with consumer protection on the insurance mediation market

Summary/Abstract: The article presents selected issues connected with the protection of rights of consumers of in- surance services, as set out in the Insurance Mediation Directive and Insurance Mediation Act. The regulations currently in force as well as the draft of the Insurance Mediation Directive’s new version, which is being prepared at the moment, have been analyzed.The article analyses the provisions of the Insurance Mediation Act which influence consumer rights. In the cases in which the current solutions are insufficient, changes to them have beenproposed. In many cases, solutions adopted for the distribution of investment fund units serve as a starting point for a discussion on new regulations.The article indicates four types of insurance intermediaries (insurance agent, insurance bro- ker, multi-agent and the entity operating pursuant to Article 3 of the Insurance Mediation Act). The author discusses the scope of information available in the register of insurance intermediaries, as well as other instruments set out in the Insurance Mediation Act which are intended to protect consumer rights (disclosure obligations, professional requirements, ethics, professional secret).
