A brief analysis of the need to introduce legal thresholds for the offence of driving under the influence of psychoactive substances

Summary/Abstract: In this article, the author aims to analyze the need to introduce legal thresholds, i.e. objective limits for the detection of psychoactive substances, in the case of the offence of driving under the influence of psychoactive substances. The premise of the article is based on the idea that, just as in the case of driving under the influence of alcohol there is a legal threshold, the exceeding of which shifts liability from a misdemeanour to a criminal offence, so too in the case of psychoactive substances such a limitation may be necessary. The article examines the effects of the most used psychoactive substances prior to driving a vehicle, the proposed legal thresholds, and the arguments for the adoption of such limits.
