Summary/Abstract: Although it can be considered that both the institution of deferral of the application of the punishment and the institution of suspension of the punishment under supervision as means of individualization are no longer new elements given that the former was introduced by Law 286/2009, and the second by Law 104/1992 taken over, in the New Criminal Code, there are still certain confusions that bear on the extent of certain specific obligations and that refer to those stipulated by the art. 85 paragraph 2 letter b) of the Criminal Code, or Article 93 paragraph 3 of the Criminal Code, in the situation in which two sentences that have established the same manner of execution and contain the same obligations referred to, are merged and which uncertainties we tend to clarify in the following.
