Legality and timeliness of public administration activity in the Administrative Code, between rigour, error and excess

Summary/Abstract: The present study aims to analyze how legality and expediency are regulated in the Administrative Code. Given the role they play in the activity of the administration, the legislator was concerned with finding normative solutions that would confer, on the one hand, guarantees of compliance with the law but, at the same time, ensure the „necessary freedom of action” to administrative authorities in their own organization and operation. The balance between the two elements is difficult to achieve, therefore, many times both the one who makes the law and the one who applies it make mistakes that have disruptive consequences for both the administration and the governed.
