Summary/Abstract: The Senate debate on the candidacy of John Brennan for seat of Director of the CIA was for a time filibustered by Randal Paul, well known for his libertarian views. Sen. Paul wanted to protest against the policy initiated during the presidency of George W. Bush and continued by President Barack Obama, of “targeted killings” of people accused of terrorist activity. The question that must be asked, and that is still not answered by the Administration is whether it is legal to kill an American citizen without due process of law on the basis that he/she is a threat to national security. Even during the “war on terror” the President should not be authorized to make such discretionary decisions because these belong to judicial branch. The other problems discussed in the article are: the legal foundations for the “targeted killings” policy provided by the Department of Justice and civilian casualties during drone attacks.
