Summary/Abstract: An important reason for this publication is the discrepancy in the positions of experts undertaking the task of developing special rules for public-private partnership projects. This applies not only to Polish regulations, but also to European ones (there is no point in finding any comprehensive interpretations of this concept in the primary law of the European Union). In secondary EU law, the definition of PPP appears for the first time in 2013. However, a drawback of this definition is its descriptive character, which allows for various interpretations, sometimes facilitating abuse. The chapter contains several arguments that PPP does not contradict the constitutional approach to the social market economy. The social market economy even imposes applying this form of cooperation, because it can give bet- ter economic effects, noticeable for all partners. The author argues that the category of social market economy should be extended to include the New Green Deal area, proposing a new procedure called PPP in the social and ecological governance.
