Summary/Abstract: Trademark right represents one of the rights that asembless industrial property rights. The reason of the special attention that it receivs befor other industrial propety rights and its special significance is its abillity based on its basic function wich is distincivity, that offers trade mark a unique economic beneffit to a trade mark holder. In a modern economy to have a distinctive trade mark is a safe presumption of selling goods as well domestic and world wide. The proof lies in rising number of licence contracts; and disputes that resolve infrigiment of trade mark rights. For its profits to the trade mark holder, the trade mark right is often a subject of “ mimmicin a trade mark”; unauthorised use of trade mark on goods; using protected trade mark to mark counterfit goods…In other words legal practise prooves that active use and protection of trade mark rights proportionaly influence on development of legal theory of international business law
