Summary/Abstract: The private military and security industry has become an important part of the international economy. The growing role of private military and security services, especially where they have taken over functions previously held by the state, underscores even more clearly the need to develop and set standards for respect for human rights by PMSCs and their personnel. Attempts to distinguish between PMC and PSC have failed because the two variants can be divisions of the same company and are sometimes used interchangeably, making accountability difficult, especially in the case of human rights and international humanitarian law violations. The use of PMSC by International Organizations and States has become common. International laws are vague, broad, easily circumvented and difficult to create, with conflicting definitions of mercenaries and PMSCs combined with states that can provide an easy way to circumvent the law. The regulatory environment relevant to the PMSC industry is ambiguous as a result of porous legal boundaries and inconsistent policies due to competing political and judicial systems: national, regional and international. Accordingly, it is necessary to consider how ambiguities could be reduced and turned into legal certainty through hard and soft law to prevent human rights violations.
