Short considerations on the delegation, secondment and transfer of the employees

Summary/Abstract: Although the legislation does not require a certain form for the employee’s agreement regarding the extension of the secondment and thus, taking into consideration that the civil law is the common law for the labor law, the tacit acceptance is enough, as provided in art. 1240 of the Civil Code, I consider that it would be recommended that the employer obtains a written agreement from the employee in this regard, in order to prevent ambiguous situations in labor law disputes.
