Summary/Abstract: This paper aims to analyse some legal aspects of the performance appraisal. Performance is an industrial organizational matter which has an impact on the execution of the employment agreement. The provisions of the Romanian Labour Code are rather elusive on the matter of performance; therefore it may be valuable to understand them in an industrial organizational context. Some research based on the examination of the court decisions may also have a contribution to a better comprehension of the matter.
