Summary/Abstract: A basic principle of employment law is that the parties of an employment agreement are free to negotiate the contractual terms, by taking into consideration the legal restrictions. Thus, the contracting parties may agree to adapt the standard form of the employment agreement to fit their own current needs, by including any clause not contrary to imperative statutory provisions, public order or good morals. This study aims to present the most common clauses not regulated by the Labor Code, based on the relevant case law and academic research literature, considering the development of labour relationships in the pandemic context.
