Restituţia imobilelor naţionalizate: preliminarii ale unei evaluări morale

This paper has two main objectives. First, starting from the assumption that an argument in applied ethics is an effort to deploy moral reasoning in the evaluation of a specified set of facts (a „case”), the article tries to illuminate the relevant facts for the assessment of property restitution. The conclusion will be that the case to be considered is the legal history of restitution in Romania. Secondly, it tries to identify some of the questions to which a moral assessment of a rectificatory policy should answer.

Determinanţi ai calităţii vieţii pacienţilor de etnie romă, din perspectiva mediatorilor sanitari

The Roma represent an important ethnic minority in Romania, who often face inequalities in their access to health care. The policies and the strategies that focused on reducing this inequalities and a better inclusion of the Roma have lead to the establishment of a sanitary mediators network, that is currently operating in Roma communities, thus facilitating a better communication between this particular minority and the health care professionals, as well as an improved access to healthcare services. Our study – Determinants of the quality of life of the Roma patients, from the perspective of the health mediators – focuses on identifying the determinants of the quality of life of Roma patients, and it is based on three group interviews with sanitary mediators, in the counties of Iasi and Cluj. The results indicate that, when it comes to health care services, doctors should be familiar with and aware of the cultural background of the community, their values and traditions. Communication based on respect, the development of a partnership between doctors and patients, avoiding racial labeling and prejudices are the most important requirements of the Roma, because their dignity and quality of life should not be affected under the conditions of the interaction with healthcare professionals. The activity of health mediators, persons who are familiar with members of the community, with their customs and traditions, has a positive potential in assuring the quality of life.

Operacija “Oluja” i srbijanski dnevni tisak (Večernje novosti i Politika)

In this work, the author, on the basis of newspaper stories published from the end of July to October 1995 in two Serbian newspapers, Večernje novosti and Politika, presents the relation of a part of the Serbian press to the events tied to Operation “Storm” (Oluja). The above mentioned newspapers represent an important source of information for the inhabitants of the Socialist Republic of Yugoslavia and certainly influenced the formation of attitudes and the shaping public opinion. This article will present the basic themes of interest, journalistic forms of their interpretation, and the characteristics that defined them.

Ideologija Organizacije jugoslovenskih nacionalista (Orjuna)

The article is dealing with the ideology of integral Yugoslavism of the Organization of Yugoslav Nationalists (Orjuna) during the time of its existence 1921-1929, approaching the topic from the perspective of the new cultural theories about fascism, which defines fascism as the ideology advocating the notion of the palingenetic national revolution. The article analyses Orjuna’s concept of the palingenetic national revolution, subsequently showing that the organization failed to develop in a fully blown fascist movement, due to the fact that it failed to constitute itself as the autonomous political agent tending to revolutionary overtaken of political power. Subsequently, the article is focused on the Orjuna’s central ideological concept of integral Yugoslav nation. It is shown that Orjuna, on the contrary to other fascist movement, was focus on the process of creation the new unitary Yugoslav nation. Hence, the analysis shows that the privileged position of Serb national mentality within the concept of Yugoslav unitarism is not mere and simple expression of Orjuna’s exclusive anti-Croatism, but originates from the labeling of the Croatian national-integration tradition to be inadequate ground for modeling of integral Yugoslav revolution, on the contrary to the Serb national mentality.

Ustavna uređenja temeljnih prava u Hrvatskoj 1946.–1974.

Using comparative methods the constitutional arrangement of human and civil rights is analyzed during two constitutional eras in socialist Croatia, with reference to Yugoslavia. The comparison is carried out on three levels: a synchronic comparison of the Federal constitution with the constitution of the Republic (the Constitution of the Federated Peoples’ Republics of Yugoslavia of 1946 with the Constitution of the People’s Republic of Croatia of 1947, the Constitution of the Socialist Federated Republics of Yugoslavia of 1963 with the Constitution of the Socialist Republic of Croatia of 1963), a diachronic comparison of the Constitution of the Federated Peoples’ Republics of Yugoslavia of 1946 with the Constitution of the Socialist Federated Republics of Yugoslavia of 1963, and a synchronic comparison of Yugoslavian constitutional arrangements with international documents concerning the protection of human and civil rights and freedoms. Prior to presenting the analysis the author theoretically defined the concepts of fundamental rights, human rights, civil rights and political rights, presented basic international documents concerning the protection of human rights and pointed to the character of the constitutional organization of socialist Yugoslavia, as well as Croatia during the period 1946-1974. It is concluded that the arrangement of the Republic’s (Croatia’s) constitution was a photocopy of the arrangement of the Federal constitution, that in the second constitutional period the rights of citizens in the constitutional texts were more precisely defined and in particular measures broadened, and that Yugoslavia in its constitutional arrangements did not entirely adhere to international acts concerning the protection of human and civil rights. Socialist Croatia, as a part of Yugoslavia, was part of a socialist legal entity in which the question of the protection of individual rights was a peripheral matter.

Proračuni dalmatinskih općina na početku XX. stoljeća (1900.-1908.)

This article analyzes the budgetary revenues and expenses of Dalmatian municipalities at the beginning of the 20th century. A summary overview is provided of the budgets of all 90 Dalmatian municipalities and of the 14 districts to which they belonged. The year 1900 is chosen as the starting point of the analysis and the year 1908 is chosen as the endpoint. Along with this an index of population growth or decline is provided as well as of budgetary revenues and expenses during this eight year period. For four Dalmatian municipalities, Vrgorac, Benkovac, Vis and Split, a detailed review of budget items is provided. For the municipality of Zadar, a review of data concerning direct taxes paid by inhabitants is given, that is of individuals who by virtue of paying taxes have the right to vote. This analysis clearly shows the economic dominance of towns over villages. Namely, the urban voter pays 21 times more direct tax that the voter from the villages in the municipality. Because the municipal curial electoral system favoured the wealthier classes, this had a large impact on Dalmatian political life. All data presented is compared to the GDP statistics for the Austrian lands of the Monarchy as well as with the wider European context.

Katolički vjeronauk u istarskim školama – od potiskivanja do izbacivanja (1945.-1952.)

In the context of series of repressive measures which the Yugoslav Communist regime carried out against the Catholic Church following the liberation, and with the aim extorting allegiance or, on the other hand, completely eliminating the social role of the Church, what took place, sometimes openly, sometimes secretly, was the repression of religious instruction as a subject of the school curriculum. In this article, on the basis of archival sources, the author traces the path from repression to complete suppression of religious instruction in schools in Istria. In certain situations an attempt was made to give repressive measures against religious instruction in schools a formal legalistic basis, in which case legal decrees were rather freely interpreted. The prohibition of religious instruction, according to the decree of the minister of education, science and culture was merely a logical conclusion to the various measures taken previously against religious instruction in state schools.

Političko opredjeljivanje birača kotara Dubrovnik 1931.–1940.

This article describes the political affiliations of voters in the district of Dubrovnik from 1931 to 1940. In it the author presents statistical data of parliamentary elections for the National Assembly of the Kingdom of Yugoslavia (1931, 1935, and 1938) as well as local elections for the 1936 and 1940 elections. In conjunction with this the author follows political conditions in the district as well as campaign propaganda. From this analysis, the author concludes that in all elections after 1935 in the Dubrovnik district the Croatian Peasant Party was dominant, while the pro-regime centralists and unitarists were roundly defeated.

Fizičar i publicist Danijel Uvanović – prilog znanstvenom i političkom životopisu s bibliografijom radova

The work contains a systematic presentation of the life and work of Daniel Uvanović. The first, to be presented is a survey of the up-till-now published texts about Uvanović, which describe him as a journalistic-scientific publicist and a scientist. The information about him has been collected by means of the systematic research of the intact archival materials. It is the matter of the data from the Archives of the Faculty of Humanities and Social Sciences in Zagreb, archival materials of the Croatian Journalists’ Association, Croatian National Archives and the National Achieves in Zagreb. The texts and polemics of Uvanović are presented in Hrvatska Straža, dealing with scientific issues. His philosophic attitudes have been specially described; as for instance, the principles of causality and free will and the attitudes exposed in his articles in various journals. At the end, there is published the first attempt of completing his authorial bibliography.

O periodičkom tisku za hrvatsku mladež u Istri početkom XX. stoljeća

Even following the Austro-Hungarian Agreement, by which it was attached to the Austrian part of the Habsburg Monarchy; Istria found itself in difficult circumstances, right until the collapse of the Monarchy. It continued to remain isolated from other Croatian lands. Even though the majority of its population consisted of Croats or Slovenes, Italian was the official language of Istria. Favouritism on the part of the Austrian authorities meant that the Italians of Istria enjoyed control over a majority of the district assemblies, in the Provincial Committee, and in the Istrian Sabor (parliament). The struggle of the Istrian Croats to preserve their own national identity took place in rather difficult conditions, but gradually, it was ever more successful. A significant growth in the number of Croatian primary schools took place after the founding of the Society of St. Cyril and Methodius in Istria in 1893. The Croats of Istria also founded and supported their own political newspapers and specialized journals. They likewise established literary journals for their youth: Mladi Istran [Young Istrian] (1906-1907), which was published in Mali Lošinj, and Mladi Istranin [Young Istrian] (1909) and Mladi Hrvat [Young Croat] (1910-1914), which were published in Opatija. These journals had an important national-educational and cultural-historical mandate, and were to play a part in the national integration of the Croatian youth of Istria, thus they became interwoven in the fabric of the cultural history of Istria in this era.

From the courtyard, the grey February afternoon illumined his serious, bearded face, his prominent cheekbones and deep-set eyes; the small square cut into the wall glimmered right above Uri’s tousled, greasy hair. His father stood there looking grave, not casting another glance at him, just staring out the window.
