The anti-competitive effect is the hallmark of market dominance abuse. Neither the European Union Competition Law nor the Bulgarian Competition Law contains a legal defi nition of this term. It is linked to the term “competition“. The concept of competition is borrowed from economics. The interrelationship between market dominance and market dominance abuse outlines the subject-matter of this article. The present research examines the essence of the anticompetitive effect in the context of those economic concepts of competition that underlie the doctrines of market dominance.

Банковият надзор като специализиран административен контрол

The article analyses the concept of banking supervision as a specific administrative control. It begins with a brief overview of the two concepts "Bank" and "Banking Business", as legal phenomena determining the Banking Supervision. After this introductory part, the research focuses on the Banking Supervision as a legal institute of Bulgarian positive law. The different legal terminology related to it, used in banking legislation, is also analysed. The theoretical conception divides the generic concept of banking supervision into two specific forms of its addressees. Finally, we pay attention to the Macroprudential Supervision under Art. 79, Para. 2 of the Credit Institutions Act (CIA) and the Supervision of the Financial Institutions under Art. 3a CIA. The study proves that they are independent legal concepts, beyond the Banking Supervision.

Бинарна поверителност – взаимни връзки между блокчейн технологията и защитата на лични данни в ЕС

The article outlines the main interrelations between the modern technology of blockchain – a method of recording information through cryptographic models in an infi nite sequence – and the protection of personal data and privacy in light of the General Data Protection Regulation (GDPR). Consideration is given to the socioeconomic prerequisites for the emergence of this new technology and a description is made of its basic functions and modes of operation. Following an overview of the origination of this technology, an analysis is conducted of the interrelations between privacy and blockchain technology, namely, what is denoted by ‘personal data’ under the General Data Protection Regulation and the practice of the Court of Justice of the European Union, whether the data and information stored through blockchain technology comes under the defi nition of ‘personal data’ and, if so, what data can be found. In the end, some technological solutions are discussed that might contribute to bringing closer the practical use of blockchain technology and the regulation in the field of personal data protection, and a comment is given about the future development of legislation and practice in this aspect.

The present study is the first one that aims to present a comparative analysis of the bills for the use of the Bulgarian language introduced in the Parliament since 2004. The conclusion reached as a result of the comparative analysis is that the texts of the bills have quite a lot in common rather than having differences in terms of both the main ideological positions and the weak points that prevented the adoption of such a law over the years. In addition to this, the conclusions impose the idea that a qualitatively new approach is needed in the drafting of the normative act– the law on the Bulgarian language should regulate a unified state language policy to protect the language as the basis of national identity and thus to encourage the development of education, science and culture in the Republic of Bulgaria.

Thе paper discusses the administrative social right to vaccination in the context of European and Bulgarian administrative law. It examines the interaction between the rights to privacy, freedom of religion and the right to health according to their content in the European Convention on Human Rights, the Constitution of the Republic of Bulgaria and current legislation. Also, the paper comments on the case law of the European Court of Human Rights (ECtHR) on these rights in relation to health hypotheses, aiming to strike a balance between the individual rights of citizens and social rights important for society as a whole. In the light of the case law and legal framework, the paper discusses the extent to which interference with the scope of these rights is regulated by law, pursues a legitimate aim and is necessary in a democratic society.
