Constituting the Cadaster, a unified system of data on real properties and information about holders of possession rights to the real properties implies that the data from land registries will no longer be public. Law on Survey and Cadaster of Republika Srpska left the administration in charge of constituting the cadaster, providing for court jurisdiction only in the case a party actively denies a right inscribed into the cadaster. Other than leaving the administration in charge of the cadaster, this law has limited judicial decision-making regarding property rights thus leaving room for manipulation notably concerning property rights of returnees, refugees, and displaced persons. Principles of constitutive effect and public trust, valid through the previous system, have been breached despite being included in the new legal framework by the administration through the Rulebook on the manner of establishing and maintaining the real estate cadaster of Republika Srpska. Establishing cadaster in such a way opens the possibility of annulment of rights inscribed in land registries and the possibility for the persons who are not in fact owners to inscribe themselves as such based on the factual state of affairs.

Factorul politic al finanţării infrastructurii la nivel local

The local finance system operates in the Republic of Moldova in the conditions of a permanent deficit of resources. Our country is still monitored by the Council of Europe on the subject of local autonomy. Although the Republic of Moldova has made some progress in adopting legislation on decentralization (December 2006), the situation has not changed at all in terms of local funding. The total volume of local revenues, consisting exclusively of local taxes, provided by current legislation, represents approx. 110 million lei, of which 70 million are collected in Chisinau and Balti, and 40 million are collected in the rest of Moldova. According to the legislation existing on 15.03.08, these are the only revenues, which can be managed autonomously, independently, without the interference and control of hierarchically superior authorities. For comparison, these revenues represent about 49% of the operational budget of the Customs Service. Comparing the revenues of the 898 administrative-territorial authorities with the budget allocated in 2008 for the Prosecutor's Office of the Republic of Moldova, we will see that the latter is financed 2 times more than the budgets of all localities in the Republic of Moldova, except Chisinau and Balti. We mention that, in addition to local revenues, local authorities benefit from several types of transfers from the central budget: broken down revenues, investment allowances, special purpose transfers. They represent over 98% of the volume of all local budgets. The paradox of the current local finance system is not related to the fact that there is no money in this system, but to the way the allocated money is distributed in the system. The objective of this Policy Brief is to analyze the dynamics of budget allocations in the last 4 years, in order to determine the legitimacy, effects and results of the operation of this system.

In the context of the local public administration of the Republic of Moldova, the process of improving the act of local government, according to the principles enunciated in Law no. 436 of 28.12.2006, provides for the consultation and direct involvement of citizens in the decision-making process. According to a report monitoring the access to information and transparency in the decision-making process, carried out in 2010, the situation at local level shows a low degree of knowledge and implementation of legislation in the field. Thus, only 32.1% of the municipal / district / local authorities / institutions provide citizens with the right of access to public information. At the same time, regarding the level of knowledge of the law on transparency in the decision-making process, 49.7% of local public authorities and 40.7% of civil society answered that they know “few” and “very few”, and 36.4% from local public authorities and 11.8% of civil society “know nothing” or did not know what to answer. Through this paper we set out to investigate the extent to which local public authorities apply the provisions of the law on transparency in decision-making process no. 239 din 13.11.2008. This law is particularly important, because it regulates the dialogue and collaboration between the public sector and the recipients of the regulations elaborated by it, respectively, citizens, non-governmental organizations, business associations, etc.

Among European Union members, Bulgaria is unique in that its administrative justice provides for possibility of appeal within the supreme jurisdiction in the area of administrative law. As it is well known, certain types of cases are heard by SAC in three-judge panels and the decisions of these panels are subject to appeal before five-judge panels of SAC. This system has a number of practical inconveniences. Moreover, it completely contradicts the Western models of administrative justice, from which our country has adopted. In Bulgarian law and doctrine, the term ‘property’ is used with different content depending on their need. In these cases, it is of utmost importance for law enforcement to establish the meaning that the specific legislative act attaches to this concept. This paper shall review the legal framework regarding the debtor’s non-sequestered assets that cannot be enforced, as well as the situations in which the protection provided by the legislature lapses. Given the specifics of the proceedings and, in particular, the fact that unilateral interference in a foreign legal sphere occurs through coercion, the rules on sequestered property as well as the degree of protection afforded to the debtor are of utmost importance.

During 2014-2015, the Main State Tax Inspectorate (STS) of Moldova, supported by SIDA, as well as other donors (World Bank, IMF, USAID/BRITE and EU), implemented a series of fundamental reforms. The interventions were primarily aimed at increasing the efficiency of tax administration and stimulating the voluntary fiscal compliance by easing the communication and interaction between fiscal authorities and taxpayers. This report aims to undertake an assessment of the net impact of these reforms. The analysis will be based on econometric, statistical, as well as qualitative methods, reflecting the evolution of the fiscal system in the last couple of years, with a primary focus on tax collections and interaction with the taxpayers.
