Zarówno w przedlizbońskim, jak i obecnym stanie prawnym wspólna polityka zagraniczna i bezpieczeństwa, jako płaszczyzna współpracy w ramach Unii Europejskiej, wyróżniała się i nadal wyróżnia na tle innych rodzajów polityki prowadzonych w traktatowych ramach tej organizacji. Najważniejsze kierunki ewolucji WPZiB wytyczyły dwa traktaty, a wiec traktat amsterdamski i traktat lizboński. Ten ostatni zasadniczo zmienił usytuowanie WPZiB w ramach UE, co wiązało się z likwidacją charakterystycznej, trójfilarowej konstrukcji prawnej UE oraz z istotnymi zmianami instytucjonalnymi w jej strukturze. Specyfika współpracy w ramach WPZiB spowodowała jednak, że została ona wyraźnie wyodrębniona zarówno z całego katalogu pozostałych unijnych rodzajów polityki, jak i z całej grupy działań zewnętrznych Unii.

Lobbing jako forma wywierania nacisku na podejmowanie decyzji w różnych systemach politycznych występuje już od momentu zawiązania się pierwszej instytucji państwa. Wraz z rozwojem systemów gospodarczych nie tylko nabrał on charakteru globalnego, ale również zinstytucjonalizowanego i co za tym idzie, bardziej transparentnego. Proces ten implikuje wobec tego nową rzeczywistość również dla Unii Europejskiej, w której to lobbing odgrywa obecnie kluczową rolę przy zawieraniu umów gospodarczych z krajami trzecimi. W artykule przedstawiono sposób funkcjonowania grup interesu oraz ich powiązania i relacje z organami Unii Europejskiej. Zostało to zobrazowane na przykładach procesów pertraktacji umów o wolnym handlu pomiędzy Unią a Japonią, Kanadą (Comprehensive Economic and Trade Agreement – CETA) oraz Stanami Zjednoczonymi (Transatlantic Trade and Investment Partnership – TTIP).

Współczesny regionalizm przestaje być procesem, w który zaangażowane są głównie kraje rozwijające się. Coraz częściej pojawiają się w jego ramach gospodarki wysoko rozwinięte (np. Stany Zjednoczone, Kanada, Unia Europejska, Japonia, Korea Południowa, Australia), dla których takie działanie stanowi możliwość określenia priorytetowych dziedzin (tzw. narzucenia agendy, agenda setting) na drodze ku liberalizacji handlu i tym samym wskazania dróg jego dalszej ewolucji podporządkowanej narodowym lub wspólnie podzielanym interesom. Na tym tle umowa handlowa zawarta między Unią Europejską a Republiką Korei (Koreą Południową) stanowi porozumienie nowej generacji warte bliższej analizy. Rozważania obejmują syntetyczny przegląd głównych motywów jej zawarcia wraz z odniesieniem do wybranych badań, określenie celu oraz hipotez roboczych oraz prezentację wyników analizy w odniesieniu do zmian, jakie miały miejsce w trakcie pierwszych kilku lat jej obowiązywania w obrębie handlu towarowego, w tym w szczególności dóbr zaawansowanych technologicznie (high-tech).

Gazprom’s interests hit by CJEU judgment on OPAL pipeline

On 10 September, the Court of Justice of the European Union (CJEU) annulled a decision issued by the European Commission on 28 October 2016 allowing the Russian Gazprom to send greater volumes of gas through the OPAL pipeline. The CJEU judgment was issued following a complaint submitted on 16 December 2016 by Poland, supported by Lithuania and Latvia, against the Commission’s decision, which on the other hand was formally supported by Germany. The CJEU found in favour of Poland and overturned the Commission’s decision, saying that it had been issued in breach of the principle of energy solidarity provided for in art. 194 of the TFEU. The judgment means that the OPAL capacity available to Gazprom has now been reduced, effective immediately, by 12.8 bcm per year, as has transmission via Nord Stream and Germany, as a result. The judgment will probably remain in force, and this is a good outcome for Poland and all parties/sides interested in Gazprom’s domineering position on the European gas market being reduced, and opposed to new Russian export pipelines such as Nord Stream 2 being built. The decision will hurt Germany above all, which benefits from the increasing volume of gas being sent through the country, but will also hurt the Czech Republic and other actors that buy gas via Nord Stream. At the same time, the decision exacerbates the already existing divisions between member states. The CJEU’s judgment is evidently a blow to Gazprom and Russia, limiting Russia’s export capacity at an already difficult time (talks to negotiate a gas deal with Ukraine, and winter approaching). If it remains in force, it will mean that in the next few years, Gazprom cannot afford to stop transit through Ukraine, which is one of the main objectives of Russia’s energy policy. The ruling might also have negative consequences for Nord Stream 2, as there is less chance of the project being granted EU law exemptions. This also raises the question of if and how the principle of energy solidarity, reinforced by the CJEU ruling, can be applied to the project. For the duration, the ruling will strengthen Ukraine’s position, and that of the EU as well, in talks with Russia about transit through Ukraine in the future and the forthcoming trilateral negotiations. At the same time, it could trigger some sort of retaliation on the part of Russia.

Strategie firm w obliczu sankcji nałożonych na Rosję

Purpose: In this chapter, we analyse how companies responded to sanctions imposed on Russia after its invasion of Ukraine. We examine the impact of selected external (public-legal pressure, the size of sanctions and crisis caused by the war) and internal factors (strategic agility, code of ethics and sustainable conduct) on the degree of compliance with sanctions and the type of adaptation strategies adopted. Design/methodology/approach: The objects of the study are medium-sized companies from countries that have imposed sanctions (here, Poland, Germany and the US). The results come from an electronic questionnaire survey conducted in 2023 among 610 medium-sized companies operating in industries directly or indirectly affected by trade restrictions. Findings: The company’s code of ethics and the perceived severity of the crisis have the greatest impacton the approach to sanctions and respective adaptation strategies. At the same time, external and internal pressure affect companies in opposite directions, with consequences for their adaptation strategies.

The subject of this paper is the rights of the performing artists for their names, pseudonyms and other distinctive signs of the artist such as autograph, face, name of the work, etc. A study of applied for and registered trademarks of ten world-famous performers (singers) was carried out to ascertain the presence or absence of intellectual property rights. The number of trademarks at the national, European and international level has been identified, and the goods and services in which the trademarks are registered have been extracted. The role of trademarks as a business identifier that provides their holders with identification and differentiation from other artists in the market is indicated. Conclusions and recommendations are formulated on the basis of the implemented research.

Ekspansja usług dostarczanych cyfrowo w globalnym handlu

The chapter presents the concept, essence and types of digitally deliverable services (DDS), the category extracted from the broader group – digital trade – which, in addition to DDS, includes goods and services ordered electronically but delivered in a traditional manner (cross-border e-commerce) and trade in digital content embodied in a tangible product. As the name suggests, DDS can be delivered electronically (like ICT services, sales and marketing services, financial services, professional services, and education and training services). In the trade of these services, geographical distance and other determinants shaping trade flows in goods and traditional services have become less and less important. Based on the review of reports and data provided by UNCTAD, WTO and OECD, the author uses stylised facts to illustrate the phenomenon and discuss its determinants and consequences across different types of economies. The analysis reveals that at both – the macro- and micro-levels, on the supply and demand side of DDS, a variety of challenges and barriers can be identified. Their multifaceted, careful examination becomes necessary to understand the phenomenon and propose appropriate solutions for both those creating and offering digital services, consumers, and policymakers responsible for regulations leading to the full exploitation of the growth potential of the digital transformation of the service sector.
