The Justinian title “De poenis”, in CJ.9.47.25, severely punishes “Cives Romani” guilty of sharing information, regarding naval buildings, to the Barbarians. “Extremum supplicium” was inflicted upon the indicted. The “corpus Teodosianum” allows one to understand the reasons for the promulgation of this provision. With reference to CTh.9.40.24, this law gives an insight into the potential freedom granted to prisoners waiting for “extremum supplicium”. In the Theodosian version, the exceptional indulgence allowed towards episcopal figures, coming from within the Empire, is put in evidence. The omission of specific references made in CTh.9.40.24 from CJ.9.47.25, is attributable not only to the greater level of abstraction present in the Justinian code with comparison to the previous code, but also to ecclesiastical solicitations with regards to the established punishment.

Maritime piracy – Change factor of international security paradigm

Supporting 90% of the world’s trade, the maritime transportation is the lifeblood of the global economic system that links every country on earth. The security of maritime routes, ships and crews is critical to support the sustainability of continuous growth and globalization. The proliferation of piracy attacks during the last 10 years has shown the high security vulnerability of the open oceans, especially within the areas bordered by countries with fragile political and governmental structures. No single nation has the resources required to provide safety and security through the entire maritime domain. Furthermore, as one of the world’s „common resources” the ocean requires expanded cooperative relationships between the nations to ensure the security and stability of the maritime domain for the benefit of all. This brings in new security governance models which expand the traditional approach based on national sovereignty to regional cooperation or even a more global partnership. The European Union is one of the leading models for regional cooperation and an important driver behind a global maritime security model, as outlined in the new EU Maritime Security Strategy of June 2014. This paper investigates the impact of piracy attacks on the maritime security policies and the feasibility of a new governance model supporting the establishment of a Global Maritime Domain Awareness (GMDA) system. Based on the evidence identified within new regional and international maritime security policies issued over the last five years, the research conclude that the implementation of a GMDA model have been initiated by some of the maritime user communities, however, a truly global and harmonized model has not been achieved so far.

EVALUATION OF GREECE’S UNLAWFUL ACTIONS AGAINST THE AEGEAN ISLANDS

There are several problems between Turkey and Greece that they can be examined under many separate headings. Problems such as continental shelf, territorial waters, airspace, and not least the Cyprus conflict, have become extremely difficult to deal with as both sides have their own legal arguments. These problems, which have been on the agenda especially since the 1970s, became political and diplomatic crises and continue to be so today as well. Even though it might be assumed that the existing problems have existed since the second half of the 20th century, the origins of these problems go back to the Ottoman Empire and the existence of Greece as an independent state. The main reason for this study is to shed light on the problem of the Aegean Islands—which are scattered in the form of islands, islets, and rocks right in front of the Turkish mainland in the Aegean Sea; remained under Turkish domination for 400 years; creates security concerns from a geopolitical standpoint and can be described as indispensable—and on Greece’s attitude towards the existing problems that goes against international law.

Being in the middle of the dispute between Romania and Ukraine, the Bâstroe Channel continues to be a bone of contention both bilaterally and internationally due to the dredging operations carried out by the Ukrainian side. The present article aims, on the one hand, at the overall presentation of the chronologically reported events at the initial moments when the construction works of the Danube-Black Sea Channel were started, ending with Ukraine’s implementation of the „Bâstroe Canal” project. On the other hand, the objective of the scientific approach is to see to what extent the norms of international law were applied and respected by the state directly involved, taking into account the impact that the deep dredging on the Bâstroe Channel has on the entire ecosystem of the „Danube Delta” Reserve, both in the short and long term, with the aim of preventing and thus avoiding an irreversible ecological accident mishap

Bringing Order to the Muslim Family: Aleksandr Golitsyn and Imperial/Colonial Law for the Muslim Family

On August 25, 1822, the Minister of Spiritual Affairs and Enlightenment, Aleksandr Golitsyn, wrote a letter to the Orenburg military governor, Petr Kirillovich Essen, introducing a new project of compiling rules concerning marital and family issues among the Muslims of the Orenburg province. Golitsyn initiated this compilation as a result of a complaint by a certain Muslim (subject) on a wrong decision by the Orenburg Muslim Spiritual Assembly in his marital case. He also requested information and an opinion on this case from the Orenburg civil governor. In response, the civil governor reported about various "disorders" in Muslim families, their negative consequences, and offered his opinion about the measures that could be taken to stop those disorders. As a result of this correspondence, Golitsyn decided to compile rules on Muslim marriage. In his letter to the military governor, he underlined that he had already consulted the Tauride 2 Mufti and the Tauride Muslim Spiritual Assembly 3 about the appropriateness of these rules and their conformity to Muslim laws and traditions. The Crimean (Tauride) Mufti approved the fact that "the rules on marriage were in accordance with Muslim laws and customs."4 Golitsyn also inquired with the Orenburg civil governor whether the rules were in accordance with the local civil laws and whether it was a good idea to translate the laws into "the local Tatar language, spoken in Orenburg province" and later publish them in Tatar.
