The profile of this issue, other than public law analysis covering administrative or constitutional issues, jurisdiction and parliamentary law, includes themes which are not purely legal. They have been consciously chosen. One is dedicated to the legal and political science analysis by Jürgen Habermas. At the end of last year, parallel with the German edition, the CJP published the book An Essay on the European Constitution, which could serve as a “textbook” on historical resources of human rights, above all, human dignity: human dignity is the moral source of content for all human rights, and transnational law civilizes community and government relations of power. The potential of this opinion is inexhaustible and can be productively used in relation to civilizing effects of the constitutional law, particularly in B&H. From a scientific colloquium that was staged on the occasion of publishing this book, we bring several discussions. They remind us of the potentials of Kant’s philosophical idea of eternal peace and demonstrate its extent of perception in modern political philosophy. The second topic includes a state-legal base and theological-philosophical answer. It introduces us to a rather simple but contentious topic — Statehood Day of B&H. Instead of legal discussions, on this occasion, we publish a pertinent text by friar Ivan Sarčević, in which Bosnia’s statehood is viewed as a matter of constitution of cohesive ideas, opinions and acts that integrate between each other. A theologian is writing about the topic, employing a historical-sociological analytical procedure and precisely because of that it can be useful to lawyers as a small philosophical instruction that normativity does not necessarily bring justice, especially if it is not supported by ethics.

„Today is a historic day for Croatia and the European Union“( José Manuel Barroso, President of the European Commission). This sentence is not only courtesy attitude that July of 2013 determines as the deadline for the Croatian entry to European integration, but presenting an accurate description of the final balance of years of negotiations of Croatian membership in the community of rights and values. „Historic day“, on the one hand, for Croatia could be revolutionary breakthrough from post-war ethno-populistick public law culture into culture of the public law. Its balance sheet includes Croatian separation from the region in which was integrated, not only linguisticly, but also legally. On the other hand, the „historic day“ for the European Union is reflected in the three-year euro crisis. The Union, along with Croatian membership, will get in the fourth year of the crisis, which must be ended, either with the abolition of the common currency, or establishing a new European federation. The central issue of this Volume are selected aspects of the Croatian public law.

Protection of personal data concerns protection of privacy and it is a subject of control by the Information Administrative Law, which is regulated by international conventions, Constitutional law and other various regulations. This field has a specific meaning in public relationships, because the bodies of state government are limited by the confidentiality of personal data. About antinomian situations which arouse from regulating the matter of Croatian Information Administrative Law write Alen Rajko. His analysis goes beyond the Croatian legal framework and has a universal dimension.It can be seen in response to a question, how to deal with regulations which on the one side guarantee the right of access to information, and to the other side security and confidentiality of personal data.

Establishing a single Supreme Court in Bosnia and Herzegovina is still a matter of political testing how far the Entities can go with self-institutionalization into a governmental community. Preliminary analyses of this topic is out of the political discourse and is done through legally oriented procedure by: Nurko Pobrić, the analysis of the deficit of Dayton constitutional construct, Branko Perić, the analysis of “imposed judicial authorities” which has eliminated the absence of Dayton structure of the justice system. The first author advocates the establishment of a supreme court and shows the constitutional grounds as well as jurisdictional postulates for its institutionalization; the other author concludes that one Supreme Court is not required since currently the functioning of the system of justice is not a problem and therefore the existing system should be stabilized with the harmonization of entity laws. Both analyses deserve careful reading and even more careful comparison of opposing arguments. Reviewing the analysis in the context of jurisdictional practice and the demand of jurisprudence that has been presented in the previous issue of Volumes can give a legal answer to the question about needs, form and jurisdiction of a Supreme Court of BH.

Should Bosnia and Herzegovina have one Supreme Court? This is not just a question of academic or political importance. It is, first of all, a question of active juridical practice and achievement of justice in the process of juridical verdicts pronouncement. However, in the existing constellation, it is not possible to give one answer to that question. The analyses that follow show only the supportive arguments. They cannot be generalized and have no character of legal orders.

Das Eingangsthema dieser Ausgabe gibt den Überblick über die Fälle wieder, die die Länder der Region vor dem EGMR in Strasbourg geführt haben. Monika Mijic (BuH), Aida Grgic (Kroatien) und Vladan Joksimovic (Serbien) stellen eine Bilanz der Jurisdiktion des EGMR an bezogen auf drei postjugoslawische Staaten seit im Zeitraum von ihrer Aufnahme als Mitgliedschaft in den Europarat bis heute dar. Diese zeigt, dass die analysierten Staaten, wenn sie auch ihre rechtlichen Wurzeln im selben Rechtskreis und annähernd gleiche Indexe hinsichtlich der Anzahl der Entscheidungen pro Bevölkerungsanzahl haben, spezifisch ausgeprägte Konstellationen bezüglich der Verletzung der Konventionsgrundrechte verzeichnen.

The twenty-fifth anniversary of the fall of communist regimes in Central and Eastern Europe prompted us to explore the current state of research on media and democratization in the region. It has been clear that some aspects of the media's role in these “new” democracies have been the subject of ongoing investigation – above all the transformation of state broadcasters into public service ones – and hence we decided to turn our attention to research on newly emerging phenomena – such as the relationship between new media and democracy or the emergence of domestic media moguls – as well as to questions that have been under-represented in international scholarly research.
