Deprivation of Liberty - ‘Medical Punishment’ during the State of Emergency in Romania

The state of emergency established in Romania as a result of the epidemiological evolution determined the authorities to take extraordinary measures to limit the pandemic's negative effects, being adopted rules stating that individuals for which self-isolation or quarantine was established who do not comply with these measures will be forcibly placed into quarantine, under guard, being held for criminal liability, and also put to pay the expenses incurred. To these considerations, the present study proposes the thesis that the forced quarantine must be assimilated to placing the person in detention, within the meaning of the criminal law for this, contemplating that the state has violated procedural rights of individuals, as well as the right to free access to justice, the measures imposed by the analyzed rules aiming in fact at the most drastic resort possible, without giving the possibility to establish proportionate measures. The study also shows that the rules exceed the framework of the tactical police measure of leading persons to the headquarters of a judiciary organization, as well as that the misdemeanor or criminal punishment of persons who do not comply with the measure of self-isolation or quarantine, complementary to the measure of forced quarantine and the imputation of the expenses occasioned by this measure, violates the criminal procedural principle ne bis in idem, given that the authorities have in fact sought to double sanction individuals targeted by these measures. In order to demonstrate the submitted theses, a qualitative analysis will be made of the concepts captured in the jurisprudence of the constitutional and the supreme courts of Romania, as well as in the cases of interest with which the European Court of Human Rights was invested, not least, pointing the discoveries reported in the criminal doctrine on the elements introduced in this paper.

The right to vote is a constitutionally guaranteed right of citizens to elect representatives and to be elected to the representative bodies of a given state. As a subjective public right, the right to vote is a way of indirect participation of citizens in the political life of the state. The main difference between the electoral models, which in itself is based on the legal and political dilemma of which electoral model is best, is directly related to the proportionality of the election results. In this regard, proportional electoral models more reliably reflect the political mosaic of a given society within its parliamentary structure. Therefore, in the electoral literature, it is usually emphasized that the ratio between the votes and the mandates won is provided more in the proportional electoral models than in the majority electoral models. However, the main dilemma is related to the research question of how proportionate is the proportional electoral model and what are the main factors that affect its proportionality. Therefore, with this paper author by explanation of the electoral system of North Macedonia, using: legal interpretive methods, statistical and comparative methods as well as the method of simulating of the election results with one constituency of the last five parliamentary elections in this country (2008, 2011, 2014, 2016 and 2020) held according to the proportional electoral model with six constituencies, will focus on the specific analysis of recent requirements of small political parties for reforming the electoral system with a single constituency, analyzing the advantages and disadvantages of such an electoral reform, taking into account the lessons from the experiences of countries in the region such as: Kosovo and Serbia that implement this electoral system.

The study analyzes the interaction between fiscal and monetary policy in the context of the measures against the Covid-19 crisis. In order to do that, first, the idiosyncrasies of the economic crisis, that necessitate coordinated stabilization policy, are identified. Next, these idiosyncrasies are linked with the stabilization potential of both types of macroeconomic policy and arguments are put forward for the synergistic effect of the coordination 174 process. In the last part of the study the focus is on the USA and the EU as special attention is paid to the comparative analysis of the time coordination in the application of the budgetary and monetary policy.

The article analyzed the powers of president of the Republic of Bulgaria conclusion which can be reached is that the Bulgarian constitution are a number of false and conjuncture solutions as a result of which there is inadequate transformation of the high electoral legitimacy of the president in significantly reduced institutional capacity. The limited constitutional powers of the President are a serious structural defect of the system of state power in Bulgaria , which leads to a violation of the necessary balance between the authorities and does not hinder the establishment and functioning of the system of mutual control between them. It is necessary that the constitutional powers of each state institution should be harmonized as much as possible with its legitimate status. In this connection defines our proposals from functional systemic and structural nature that would allow the presidential institution to take a more independent and equal position in relation to other states power. They would provide an opportunity for the Bulgarian president to be given a new, important role in the system of government. The new increased, functional capacity of the presidential institution would enable it to take its rightful place, given its degree of legitimacy. New they functionalities of the presidential institution would allow it and be an important factor in strengthening of statehood , as well as reorganization of the political system in Bulgaria.

The new European Commission with a 2019-2024 mandate has already its first strategic document. This is the programme that her President has presented to the European Parliament before the election for her new position. The document is signed by Ursula von der Leyen and is called: “A Union that strives for more. My agenda for Europe”. Notwithstanding this ambitious title, the document does not contain new ideas in the area of reforming the Economic and Monetary Union. It only repeats already known reforms that were undertaken by the previous European Commission (2014-2019) under the Presidency of Jean-Claude Juncker. In the current paper an overview of the EMU reforms that are proposed by Ursula von der Leyen will be presented. An analysis will be done on the level these reforms correspond to the previous agenda of the EU, before the last elections for the European Parliament in 2019.

Dar anlamda, gelişmiş teknolojilerin yardımıyla bireysel özelliklerin ve yeteneklerin geliştirilmesi anlamına gelmektedir. Ayrıca, teknolojik geliştirmeyi nasıl anlarsak anlayalim, dikkate alınması gereken yeni “ethos” ve geliştirme teknolojilerinin ürettiği etki (affect) türleridir; posthümanizm insani ve hümanizmin insan merkeziyetçiliği sorgulayan, farklı disiplinlerden etkilenmiş ve teknolojiyle de yakından ilgilenen yeni bir vizyon geliştirmiştir. Son yılların geliştirme teknolojilerini ve bunların etkilerini anlamak için hem bu vizyonu, daha önemlisi bu vizyounun felsefi dayanaklarını araştırmak gerekmektedir. Bunu anlamak için de sorunun köküne gitmeli, insan ilişkilerinin mikro ve makro düzeylerinde çalışan güç yapılarını ve biçimlerini Geştalt (Gestalt) ve teknolojinin bu ilişkilerde nasıl yürüdüğünü incelemeliyiz. Bu yazıda bu araştırmayı yapabilmek için öncelikle Friedrich Nietzsche’nin güç üzerine geliştirdiği fikirlerini inceleyeceğim. Sonra, Martin Heidegger’in teknoloji eleştirisini kısaca özetleyip, Michél Foucault’nun Nietzsche/Heidegger ekseninde dönen kurum eleştirisi bağlamında ortaya koyduğu biyo-güç tezlerine değineceğim. Yazımın en son kısmında da çağımızın bazı geliştirme teknolojileri uygulamalarına geliştirdiğim felsefi çerçeveyi kullanarak tartışacağım.

From the standpoint of economic transformations, Vietnam‘s development has been described by experts as a real miracle, which gives grounds for the country to be qualified in the modern scientific literature as a „Southeast Asian tiger of transition“. In this respect, the paper explores the processes of reforming of the state through the lens of their historical, economic and political aspects. As a key element is identified the policy of „Doi Moi“, which is the basis for renewal and progress. The research also discusses the formed specific „system of market socialism“ that has an impact on the explicit measures that are being implemented so as to accelerate not only the domestic economic development but also the intensification of external economic relations. The author looks also at Vietnam‘s accession to important international organizations such as ASEAN and the WTO, and the creation of favorable business climate of welcoming tax policies, assisting the country to stand out among the areas of high attractiveness to foreign investors.

Enlargement of the euro area seems illogical, especially in the context of the economic and health crisis that the European Union is still in. But the EU has proven that when there is a crisis, it can create “more Europe”. The Baltic countries – Estonia, Latvia and Lithuania – joined the euro area in 2011, 2014 and 2015, respectively, when the previous global economic and financial crisis was still in force or slightly fading. Bulgaria and Croatia joined the Exchange Rate Mechanism II (ERM II), called the forefront of the euro area, and the EU Banking Union, respectively, in the summer and early autumn of 2020. This happened precisely in the midst of the current economic and health crisis caused by the COVID-19 pandemic. This may lead other non-euro area Member States to think more seriously about the prospects of preparing for the adoption of the euro. The Brexit crisis also raises important questions about the future of the single currency. The current analysis aims to determine whether it is possible in the context of the economic and health crisis to work on enlarging the euro area.

The article aims to review the Stabilisation and Association Agreements between European Union and the countries of Western Balkans and to outline the Bulgarian contribution to the process of integration of the states from the region in the EU. The review has considered two main aspects – implementation of political and economic reforms – according to official reports and statistics of EU. The following conclusions were drawn: the Stability and Association Agreements have a beneficial impact on the countries from the Western Balkans and two states are effectively implementing political and economic reforms – Albania and North Macedonia. The Bulgarian contribution to the integration of the states from the region is political, but Bulgarian policy is not consistent especially in the transport connectivity and the attitude towards EU membership of Republic of North Macedonia.

The article discusses the issue of bilateral relations between Bulgaria and the Republic of Northern Macedonia and especially Bulgaria’s position on the possible membership of our western neighbor in the EU. At present, Bulgaria is blocking the negotiation process due to unresolved historical issues. The relations between the two Balkan countries bring a lot of negatives to everyone and for this reason it is necessary to find a long-term strategic solution that satisfies both countries as soon as possible. The study analyzes the benefits and losses for Bulgaria depending on the chosen position, as well as proposes a slightly different, pan-European consolidated approach, according to which all current EU member states to unite and defend their full membership, thus demonstrating unity.

Each mechanism has its specific advantages and disadvantages, which are to be tested in a turbulent economic landscape, characterized by the rising inflation rate and the quantitative tightening process led by the central banks. Through this study we set out to examine in a comparative manner the above-mentioned possibilities, trying all the time to tackle the problem from both an economic and a legal perspective.

The article’s thesis is that the political myth finds its proper meaning in the republican dictionary. The myth founds a specific political community and its way of self-understanding. It becomes a story about the origins and sources, and thus – a story that shapes the collective identity. Political myths contain symbolic representations of power, justifying present or postulated relations in the realm of politics. Usually, myth is viewed as the opposite of reason. This way of thinking has a very long history. Already the Greeks contrasted logos and mythos. The most famous creator of political myths – Plato – considered the myth a rhetorical tool complementing the rational argument. A similar albeit radicalised approach was continued in the Enlightenment, dismissing myth as the primary consciousness that should give way to true knowledge on the path of progress. In the nineteenth century, interest in the myth returned. However, it was often accompanied by various opinions – from highly negative to positive, becaus eemotions were recognised as an essential element in a political message. At the same time, however, another tradition of political mythology developed, which made reference to the republican dictionary and was related to the narrative approach to identity. The myth pointed to the uniqueness of the political community. It revealed the individual character of the community, and its special features were associated with authority and political tradition.

The ‘linguistification of the sacred’ belongs to the most overlooked concepts in the whole body of theory by Jürgen Habermas. First introduced in his seminal work Theory of Communicative Action, it reappears in Habermas’s later writings, especially after the so-called ‘post-secular turn’ in his thought. The article aims to trace this concept’s development and shed some light on the shifting functions it seems to perform in Habermas’s theorising. Furthermore, it juxtaposes Habermas’s later understanding of ‘linguistification of the sacred’ with the account of religion and the sacred developed by Polish philosopher Leszek Kołakowski.

The figure of a ‘City upon a Hill’ (New Jerusalem) occupies a distinctive position in the system of symbolic images characterising the American republic. It provides a crucial interpretative key for the American political project. The vast literature on this subject leads many scholars to a misperception: they tend to project the Puritan mindset, typical for New England, upon the entire English colonisation in America and, while doing so, overlook the diversity of the American political tradition as well as the fundamental role played by regions in shaping a complex identity of the burgeoning American society. This paper presents an alternative and lesser-known concept of America as a New Troy and captain John Smith as an American Aeneas, which emerged in the Southern colonies soon after the establishment of Jamestown. The figure of New Troy contains a semantic field which implicates the interpretation of American political tradition in the alternative or even antithetic terms to that of New Jerusalem. The teleocratic, highly moralistic and, according to some scholars, even gnostic concept of the ‘republic of saints’ was contrasted by Southerners with the conservative vision of a nomocratic political order, sanctioned by tradition and dedicated to the preservation of the status quo. This paper argues that by discussing and contrasting both visions, we can better understand the cultural roots of specific fundamental differences in the mindsets of Americans living in different regions of the United States, both from a historical and contemporary perspective.

Is the philosopher’s view of the political reality more penetrating, and is his judgment more balanced than the views of ordinary people? It is worth looking at one of the first answers to this question – a metaphorical answer which, due to the complex and labile nature of the political matter, not so much solves the issue but instead gives food for thought and invites thinking. Starting from the image of the cave outlined by Plato in Book 7 of his Politeia, this text tries to shed some light on the role and fate of the philosopher engaged in political thinking.

Wolność akademicka a pragnienie prawdy

The paper undertakes the problem of the relationship between academic freedom and the pursuit of cognition of truth. The question of the freedom of science appears for the first time in the writings of Aristotle, who associates the freedom of cognition with its ‘non-utility’, i.e. the absence of goals that treat cognition instrumentally, and with the freedom of the researcher from the influence of non-scientific factors (e.g. pressure of power, economic interests). In Aristotle’s opinion, practical and productive sciences are more necessary but less worthy. In Plato’s understanding, the freedom of science is closely related to the freedom from the obligation to deal with politics. The author analyses to what extent these concepts of academic freedom are valid and realised today. This is done in relation to the way the four classical faculties function and the ‘fifth faculty’, i.e. the natural sciences. The current relationship between science and politics is also examined in more detail.
