LGBTI Persons in the System of Protection Against Domestic Violence

LGBTI osobe u sistemu zaštite od nasilja u porodici

Nasilje u porodici nad LGBTI osobama prepoznato je kao sistemski neadresiran problem. Zakonom o zabrani diskriminacije BiH, krivičnim zakonima, zakonima o zaštiti od nasilja u porodici, te međunarodnim standardima predviđena je zaštita od nasilja u porodici svih osoba, bez obzira na seksualnu orijentaciju i/ili rodni identitet. Ipak, istraživanje je pokazalo da u praksi i dalje postoje problemi koje je potrebno adresirati kako bi osobe koje su bile žrtve nasilja u porodici zbog svoje seksualne orijentacije i/ili rodnog identiteta bile adekvatno zaštićene. Organizacije koje vode sigurne kuće u BiH imaju volju i razumijevanje za pružanje pomoći, ali su ograničene kapacitetima, finansijskim sredstvima koja često nisu blagovremeno uplaćena, ali i znanjem o specifičnostima potreba i pristupa LGBTI osobama. Osim toga, sigurne kuće mogu zbrinuti isključivo žene, odnosno lezbejke i osobe koje se izjašnjavaju kao muškarci, ali još uvijek imaju biološke karakteristike žene, te maloljetne osobe. Stoga pitanje zbrinjavanja gej muškaraca, trans muškaraca koji su u potpunosti prilagodili spol svom rodnom identitetu ili trans žena koje još uvijek nisu u potpunosti prilagodile svoj spol, ostaje neriješeno. Nepostojanje policijske evidencije o prijavljenim slučajevima nasilja u porodici nad LGBTI osobama ukazalo nam je na određene probleme. Prvenstveno, LGBTI osobe nemaju dovoljno povjerenja u institucije, može se reći da čak i strahuju od reakcija osoba iz institucija. Institucije imaju pogrešnu sliku o položaju LGBTI osoba, odnosno stiče se pogrešan dojam da ne doživljavaju nasilje, te da samim tim nema potrebe da se pozabave ovim problemom. Kroz upitnik namijenjen LGBTI osobama utvrđeno je da je 72% osoba doživjelo neki oblik nasilja u porodici, od čega su sve osobe koje su doživjele nasilje odgovorile da su, pored nekih drugih oblika, doživjele psihološko nasilje. U preko 60% slučajeva počinitelji nasilja su roditelji. Anonimni intervjui s dvije osobe iz LGBTI zajednice ukazali su nam na ogroman problem za koji se društvo, a institucije prije svega, pravi da ne postoji, a to su konverzivne terapije. Pokušaji liječenja LGBTI osoba, i to često od stručnih lica koja bi trebala imati najviše znanja, razumijevanja, profesionalizma i senzibiliziranosti, moraju biti kriminalizirani. Naravno, moramo imati na umu da se radi o praksama koje se obavljaju pod krinkom terapije usmjerene na liječenje anksioznosti i sličnih problema, te je jako teško imati nadzor i kontrolu nad takvim procedurama. Jedan od načina je da osvijestimo stanovništvo, prije svega porodice, o štetnosti takvih terapija koje apsolutno ne mogu imati nikakav uticaj na seksualnu orijentaciju i/ili rodni identitet, već samo ozbiljne posljedice po mentalno zdravlje osobe. Kada je riječ o nasilju u istospolnim zajednicama, nažalost, nismo pružili/e mnogo informacija. Istospolne zajednice još uvijek nisu zakonski regulisane, te stoga nasilje koje se dogodi unutar ovih zajednica ustanove ne tretiraju kao nasilje u porodici. Osim toga, ne postoje istraživanja za teritoriju BiH koja bi mogla pružiti nešto više podataka. Na samom kraju zaključujemo preporukama koje su izvedene i iz preporuka LGBTI osoba koje su doživjele nasilje u porodici, a obuhvataju osnivanje sigurne kuće namijenjene za smještaj LGBTIQ osoba koje su doživjele nasilje, senzibiliziranje osoba u institucijama koje pružaju zaštitu, podizanje svijesti kroz medije, društvene mreže i saradnju s obrazovnim i zdravstvenim ustanovama, kriminalizovanje konverzivne terapije, te vođenje evidencije o motivima za počinjenje krivičnog djela nasilja u porodici kako bi se dobila jasna i precizna slika o stvarnom položaju LGBTI osoba u sistemu zaštite.

Sarajevo’s urban transport system, once advanced but then devastated during the war, has been patched up to serve its users. However, the increased use of motor vehicles, inadequate public transport, and environmental concerns have led to dissatisfaction, with heavy traffic during rush hours and reliability issues within the system. The Canton of Sarajevo has significant decision-making power over urban mobility, focusing on sustainable development and aligning its initiatives with the EU Energy Strategy 2030 and sustainable development goals (SDGs). Despite the efforts outlined in the Sustainable Urban Mobility Plan (SUMP), gender equality is inadequately addressed, and broader issues such as long wait times and travel distances are overlooked, impacting women’s experiences and necessitating a more inclusive urban planning approach. The plan also overlooks the urgent need for gender-sensitive public transport to enhance women’s mobility and autonomy. The Canton of Sarajevo’s Gender Action Plan (GAP) also falls short in recognising and addressing gender gaps in traffic and urban mobility. A survey undertaken by the Sarajevo Open Centre in September 2023, with the aim of understanding issues faced by women, was answered by 213 women from the Canton of Sarajevo aged predominantly 35 to 50. The survey included questions on safety and accessibility for mothers, pregnant women, and older women and offered a worrisome view of the vulnerability of women and of gender disparity, both of which as yet remain unaddressed. Expensive tickets in Bosnia and Herzegovina disproportionately affect those families with a single working member and multiple children. Daily public transport use by women is common (49.8 per cent), with 52.6 per cent needing multiple transport modes within a single day. Women usually spend BAM 50 to 70 (EUR 25 to 35) on tickets per month (22.5 per cent). Public transport significantly impacts daily life decisions related to economic opportunities and safety. A significant number of the women surveyed had experienced violence and generally felt unsafe using public transport, particularly female workers working night shifts. Despite high rates of harassment, official statistics are lacking, and 93 per cent of women feel that public transport lacks clear information on reporting and preventing incidents. However, there are existing practices that can be seen as models, such as those used in Vienna, London and Madrid, which – in synergy with practical mechanisms to enforce gender considerations in public transportation projects by local authorities and with financial institutions providing loans – could offer high-quality public transport that addresses these gender-specific disparities and improves women’s overall mobility and autonomy.

Urbani transportni sistem Sarajeva, nekada napredan, a potom uništen tokom rata, popravljen je kako bi zadovoljio svoje korisnike/ce. Međutim, povećana upotreba motornih vozila, neadekvatan javni prevoz i briga za okoliš doveli su do nezadovoljstva, prvenstveno zbog gužve tokom saobraćajnih špica i problema s pouzdanošću unutar sistema. Kanton Sarajevo ima značajnu moć odlučivanja nad urbanom mobilnošću, pri čemu se fokusira na održivi razvoj i usklađuje svoje inicijative s EU energetskom strategijom do 2030. godine i ciljevima održivog razvoja (COR). Naporima koji su navedeni u Planu održive urbane mobilnosti (SUMP), međutim, nedostaje aspekt rodne ravnopravnosti. Zanemaruju se šire teme poput dugih čekanja i udaljenosti vožnji, što utiče na iskustva žena i zahtijeva sveobuhvatniji pristup urbanom planiranju. Plan također zanemaruje i hitnu potrebu za rodno osjetljivim javnim prevozom, kako bi se poboljšala mobilnost i autonomija žena. Gender akcioni plan Kantona Sarajevo (GAP) također je nedostatan kada je u pitanju prepoznavanje rodno uslovljenog jaza u kontekstu saobraćaja i urbane mobilnosti. Na anketu koju je Sarajevski otvoreni centar sproveo u septembru 2023. godine odgovorilo je 213 žena iz Kantona Sarajevo, uglavnom dobi od 35 do 50 godina. Cilj ankete je bio razumjeti probleme s kojima se korisnice javnog prevoza susreću. Između ostalog, uključivala je pitanja o sigurnosti i dostupnosti za majke, trudnice i starije žene. Anketa je pružila zabrinjavajući uvid u ranjivost žena i rodnu neravnotežu, što su teme koje se inače ne obrađuju. Skupe karte za prevoz u Bosni i Hercegovini nesrazmjerno pogađaju porodice s jednim zaposlenim članom i više djece. Žene često svakodnevno koriste javni prevoz (49,8%), a od tog broja njih 52,6% koristi više vrsta prevoza u jednom danu. Žene obično troše od 50 do 70 KM (25 do 35 EUR) na karte mjesečno (22,5%). Javni prevoz značajno utiče na svakodnevne odluke o životu koje se tiču ekonomskih prilika i sigurnosti. Značajan broj žena koje su anketirane doživjele su nasilje i općenito se osjećaju nesigurno koristeći javni prevoz, posebno žene koje rade noćne smjene. Uprkos visokim stopama uznemiravanja – službene statistike nedostaju – 93 posto žena smatra da javni prevoz nema jasno naznačene informacije o prijavljivanju i sprečavanju incidenata. Međutim, postoje već utvrđene prakse koje se mogu smatrati modelima, kao na primjer one koje se koriste u Beču, Londonu i Madridu. U sinergiji s praktičnim mehanizmima lokalnih vlasti za sprovedbu rodne osviještenosti u projektima javnog prevoza – i uz kredite finansijskih institucija – ove prakse mogu pružiti visokokvalitetan javni prevoz koji bi uzeo u obzir ove rodno specifične nejednakosti i poboljšao ukupnu mobilnost i autonomiju žena.

The BiH Civil Society Initiative for UPR is an informal coalition of fourteen (14) civil society organisations from across Bosnia and Herzegovina (B&H) which act in various fields of promotion and protection of human rights.1 In December 2018, Sarajevo Open Centre gathered potential members of the Initiative by targeting expert human rights organizations in different fields. The methodology for the joint submission included choosing the recommendations from the previous 3rd cycle of the Universal Periodic Review (UPR), desk research of the recommendation status, researching the measures and activities necessary for the realization of the recommendation, measure realization status and the activities of the recommendation in B&H, as well as the recommendations for the relevant institutions. Considering that the members of the Initiative have been acting in the field of human rights protection and promotion in B&H for a number of years, apart from desk research, they have also used the information gathered during their work with the target groups. Since its establishment, this is Initiative’s second joint submission. The following Initiative’s members submitted information for the joint submission: Balkan Investigative Reporting Network (BIRN), Civil Society Promotion Center (CPCD), CURE Foundation, Helsinki Citizens` Assembly Banja Luka, My Right – Empowers People with Disabilities, Sarajevo Open Centre (SOC), Transparency International in BiH (TI BiH), TRIAL International. In the period 2019-2024, B&H faced many challenges which had an effect on the protection of human rights of the B&H citizens. Although the NPM is in the process of being established, it is not yet operational. Government levels in B&H still react on ad hoc basis with no systematic approach to gender inequality. The Constitution of B&H remains discriminatory, both in terms of the participation of "others" in legislative and executive power, and in terms of gender equality. Women are consistently underrepresented in executive bodies at the entity, cantonal, and local levels. Many of the goals and activities that were set out in the Action plan to Improve the State of Human Rights and Fundamental Freedoms of LGBTI People in B&H for the period 2021-2024 are not implemented yet. The relationships between same-sex partners and their partnerships are not regulated in any administrative unit in B&H. The executive and legislative authorities at the B&H level should prioritise the adoption of the new Law on the Protection of Persons who Report Corruption. The resolution of war crimes cases has been extended by two years since the existing deadline stipulated by the Revised Strategy for War Crimes Cases was not met. HRDs face a lack of public support for their work, and violence against them often goes unpunished, sometimes even encouraged. Rare efforts are invested in making online and offline space for civil society safer. Systematic and coordinated actions of all relevant actors' are needed for comprehensive and sustainable improvements of rights of people with disabilities. Within the content of this submission, the referenced number of the recommendation for Bosnia and Herzegovina from the 3rd UPR cycle on which the paragraph is referring to is indicated and bolded at the beginning of each paragraph.

Inicijativa civilnog društva BiH za UPP je neformalna koalicija četrnaest (14) organizacija civilnog društva iz cijele Bosne i Hercegovine (BiH) koje djeluju u različitim oblastima promocije i zaštite ljudskih prava.1 U decembru 2018. godine, Sarajevski otvoreni centar okupio je potencijalne članove Inicijative ciljajući na organizacije koje se bave ljudskim pravima iz različitih oblasti. Metodologija za zajedničko podnošenje uključivala je odabir preporuka iz prethodnog 3. ciklusa Univerzalnog periodičnog pregleda (UPP), desk istraživanje statusa preporuke, istraživanje mjera i aktivnosti neophodnih za implementaciju preporuke, status implementacije mjere i aktivnosti vezane za preporuke u BiH, kao i preporuke za relevantne institucije. S obzirom da članovi Inicijative već duži niz godina djeluju u oblasti zaštite i promocije ljudskih prava u BiH, osim desk istraživanja, koristili su se i informacijama prikupljenim tokom rada sa ciljnim grupama. Od osnivanja, ovo je drugi zajednički podnesak Inicijative. Sljedeći članovi Inicijative su dostavili informacije za zajednički podnesak: Balkanska istraživačka mreža (BIRN), Centar za promociju civilnog društva (CPCD), Fondacija CURE, Helsinški parlament građana Banja Luka, MyRight - Empowers people with disabilities, Sarajevski otvoreni centar (SOC), Transparency International u BiH (TI BiH), TRIAL International. U periodu 2019-2024 BiH se suočila sa brojnim izazovima koji su uticali na zaštitu ljudskih prava građana BiH. Iako je NPM u procesu uspostavljanja, on još nije operativan. Nivoi vlasti u BiH i dalje reaguju na ad hoc osnovi bez sistemskog pristupa rodnoj neravnopravnosti. Ustav BiH je i dalje diskriminatoran, kako u pogledu učešća "ostalih" u zakonodavnoj i izvršnoj vlasti, tako i u pogledu rodne ravnopravnosti. Žene su konstantno nedovoljno zastupljene u organima izvršne vlasti na entitetskom, kantonalnom i lokalnom nivou. Mnogi ciljevi i aktivnosti zacrtani Akcionim planom za unapređenje stanja ljudskih prava i osnovnih sloboda LGBTI osoba u BiH za period 2021-2024. godine još uvijek nisu realizirani. Odnosi između istospolnih partnera i njihovih partnerskih odnosa nisu uređeni ni u jednoj administrativnoj jedinici u BiH. Izvršna i zakonodavna vlast na nivou BiH trebale bi dati prioritet usvajanju novog Zakona o zaštiti lica koja prijavljuju korupciju. Rješavanje predmeta ratnih zločina produženo je za dvije godine jer nije ispoštovan postojeći rok predviđen Revidiranom strategijom za rješavanje predmeta ratnih zločina. BLJP se suočavaju sa nedostatkom javne podrške za svoj rad, a nasilje nad njima često prolazi nekažnjeno, ponekad čak i podsticano. Rijetki se napori ulažu u to da se online i offline prostor za civilno društvo učini sigurnijim. Za sveobuhvatno i održivo unapređenje prava osoba sa invaliditetom potrebno je sistematsko i koordinisano djelovanje svih relevantnih aktera. U okviru sadržaja ovog podneska, na početku svakog paragrafa označen je i podebljan referentni broj preporuke za Bosnu i Hercegovinu iz 3. UPP ciklusa na koji se paragraf odnosi.
