Summary/Abstract: One of the legal legacies of the International Criminal Tribunal for the former Yugoslavia (ICTY) is the setting of standards related to the prosecution of crimes of sexual violence committed in armed conflicts. The ICTY Statute contains one of the first formulations of rape as a crime against humanity and is a reflection of efforts to raise awareness of sexual violence in armed conflicts. The Rules of Procedure and Evidence of the ICTY adopted special procedural rules for cases involving accusations of sexual violence. Out of a total of 161 persons indicted by the ICTY, 76 persons were accused of crimes of sexual violence. This data indicates the prevalence of crimes of sexual violence during armed conflicts on the territory of the former Yugoslavia.
