Summary/Abstract: The paper uses normative and comparative law methods in the context of analyzing the international soft legislation, considering the basic theoretical principles of the concept of green labor and just transition, within the context of the general policy of sustainable economic, social and environmental development, and more specifically, the policies of adaptation to and mitigation of climate changes. It has been established that, in spite of the fact that the measures to mitigate the consequences of climate change policy are defined, the Republic of Serbia fails to adequately address the areas of labor and employment. This is the consequence of the incompleteness in the assessment of the possibilities and needs of the labor market in the context of the transition to a green economy and green labor. The role of social partners, particularly labor unions has been neglected and the public programs in the social security area have not been introduced.
