Summary/Abstract: The unitary patent (UP) and the Unified Patent Court (UPC) have a dual impact on the competitiveness of SMEs in the EU. On the one hand, they reduce transaction costs and speed up administrative procedures. On the other hand, there is a „unitary risk“ – the possibility of a centralized loss of rights, which increases inequalities vis-à-vis large corporations. The net effect depends on the ability of SMEs to develop effective IP management strategies and on institutional support to overcome information and resource imbalances.
