Summary/Abstract: Our legislation does not take into account either factual cohabitation or factual separation when determining the circle of persons entitled to a survivor‘s pension, a supplement to the pension of a deceased spouse and a death benefit. At the same time, statistics show that more and more people prefer factual cohabitation to civil marriage. It is obvious that it is time for the Bulgarian legislator to take into account social realities, as has been done in many other countries.
