Summary/Abstract: The contentious procedure is the common law procedure by which any civil case is resolved. But this contentious procedure does not exhaust the entire matter of the civil process. Legal life has also demonstrated the need to establish special procedural rules derogating from common law. Thus, for the settlement of some civil cases, the law sometimes provides special rules, different from those of common law. This, because the specifics of these cases require special forms or procedures. All these rules make up what we call special procedures. Special procedures are used not only in cases where necessity imposed a special regulation, different from the contentious procedure. All these procedures are completed with the common law procedure
