Summary/Abstract: The Romanian public administration plays a capstone role in the planning and implementation of national defense policies, governed by a complex system of laws that ensures the effective functioning of defense-related institutions and their alignment with national and international obligations. In the context of Russia’s war of aggression against Ukraine which represents the gravest threat to Euro-Atlantic security since the fall of Berlin Wall, Romania has to prepare its central and local public administration to maintain even under the most demanding conditions three core functions: continuity of government, continuity of essential services to the population and continuity of civil support to military activities and operations. This paper provides an analysis of the legal structures that underpin the responsibilities of Romanian public administration in national defense, encompassing constitutional provisions, legislative acts, and administrative regulations. In present the delineation of attributes among various governmental bodies, highlighting the most relevant responsibilities of those institutions in the defense sector. Through this examination, the paper aims to elucidate the challenges and opportunities within the Romanian legal framework, offering insights into the landscape of national defense system and its implications for the requirements of the new generation of military plans for NATO’s actions in Deterrence and Defense of the Euro-Atlantic Area.
