Summary/Abstract: The paper attempts to investigate the concept of evidence in criminal proceedings of the Russian Federation, its properties, essence, significance and grounds for declaring the evidence inadmissible. In doing so, legal issues related to the classification and characteristics of types of evidence are particularly addressed; the concept and elements of the evidentiary procedure; the subject matter and limits of proving in criminal proceedings, and the use of the results of operative-investigative actions in the evidentiary procedure. The task of this paper is to point out to the importance of differentiating the action of collecting, checking and evaluating evidence; resolving the issues referring to inadmissibility of evidence, as well as determining the system of evidence needed to prove certain facts that constitute the subject of proving. In this context, situations related to proving in criminal cases are resolved, from the perspective of the prosecution and defence.
