Summary/Abstract: The main reason why we deal with this complex, extensive and sensitive topic of the ethical and legal position of people as participants in biomedical research and clinical trials, and which we want to consider, is neither trivial nor an expression of mere scientific curiosity. Rather, the reason lies in the realization that the practice of research on humans has been conducted in an unethical manner for decades, and this, in some parts of the world, is still the case today. More precisely, individuals, and above all patients, as research subjects, were exposed to abuses and were exploited without their consent and without informing them of the risks they would be exposed to, which would harm their health and life. For a long time, the prevailing belief in the research and medical community was that if patients knew about the serious consequences they would suffer as a direct result of research, that is, experiments, it would "block" the procedure of their performance.
