A new approach to creating the Government of the Republic of Serbia

Summary/Abstract: In every modern legal state, ministries are the basic organs of state administration. Based on the organizational and functional concept of public administration, they are the "heart" of the administrative organization, but also of the performance of administrative activities, both in the theoretical and in the positive-legal sense. Partocracy has a dominant influence on the formation of ministries as central bodies of state administration in Serbia. Instead of partocratic criteria for the formation of ministries, "objective" criteria should be respected. By analyzing comparative legal experience, theoretical positions and positive law, we can "classify" these criteria into four basic ones: historical, theoretical, life and project. The formation of the Government of Serbia after the parliamentary elections, which were organized in May 2012, should rest on the aforementioned criteria. In the future mandate period, the new Government of Serbia should devote special importance to the project criterion.
