Summary/Abstract: The processing of personal data by the insolvency practitioner in a manner that collides with specific legislation can raise various practical difficulties in identifying and quantifying the consequences. In the mentioned context, the present study aims to clarify the aspects related to the conditions of engaging civil liability, especially those aimed to establish the existence and quantification of the damage. However, before entering the core of the controversy, I presented some aspects regarding the sanctioning system established by Regulation (EU) 2016/679 and the extent of the liability of the forms of exercising the profession of insolvency practitioner. For a better understanding of the presented ideas, in the introductory part, I also made an overview of the notions with which Regulation (EU) 2016/679 operates, but strictly related to the topic of our analysis.
