PARTICULAR ASPECTS OF THE PROVISIONAL PROTECTION ORDER

Summary/Abstract: Domestic violence is a constantly expanding phenomenon, determined by the multiple shortcomings that we can register at the family level. Superior protection against this type of violence could be obtained in the old regulation of the special law through the protection order. However, the capture of the factual elements that could lead to the proof of the reason for ordering the issuance of that order by the court was difficult to achieve. By extending the competence of the police in the sense of immediate intervention, by virtue of the provisional protection order, an important step was taken for a better practice in the field. We will try to capture in the present research the main advantages obtained as a result of the changes produced by this change.
