Summary/Abstract: Decision No 189/18 March 2021 of the Constitutional Court of Romania hasdeemed unconstitutional Art 21 Para 6 of the Law No 165/2013, the only provisionstating the means of evaluation of a real estate, thus providing the criterion of the notarial grid, which determines a legislative vacuum that needs to be filled.However, until an intervention in this regard by the legislator, it is imperative to clarify the situation of the ongoing files, in the sense of establishing the way in which the valuation of real estate is carried out, given that the process of restitution and reparation of damages caused by communism has been training for decades.
