Summary/Abstract: Background: The article is concerned with the issue of consumer access to the bank account as an instrument that nowadays is essentially indispensable to everyday existence. Due to the regulation of issues related to the subject of the study, it adopts a multidisciplinary character; in addition to regulations provided in the broadly understood banking law, reference should be made to civil and constitutional law. Furthermore, this issue was not widely commented in the Polish banking law doctrine. Research purpose: To prove that, in the author’s opinion, there are no applicable provisions guar¬anteeing the consumer’s right to a bank account. Therefore, the following structure of the text was adopted: the introductory issues set out the background for further analysis along with citing relevant statistical data, then focusing in on the basic concepts for the development of the study – consumer, bank account and bank account agreement, as well as the consumer’s right to a bank account in the context of security and financial exclusion. The summary includes the conclusions drawn from the conducted considerations, which boil down to the statement that the current regulations lack regulations sufficiently guarantee the consumer’s right to a bank account. Methods: The research was carried out using the formal-dogmatic method, while only a secondary way was used a non-legal method, the analysis of statistical data. Conclusions: The conclusion of the conducted considerations is the legitimacy of introducing regulations stronger guaranteeing the consumer the right to a bank account in the event of an unjustified refusal to conclude it.
