Gloss to the Judgement of the Supreme Administrative Court of 12 February 2018 (II OSK 2524/17)

Summary/Abstract: Everyone has the right to health protection. If the activity conducted by an entity or a natural person exploiting the environment which poses a threat to the health and life of other persons, the Voivodeship Inspectorate of Environmental Protection shall decide to cease activity to the extent that is necessary to prevent the deterioration of the environment. Preventing exploitation of the environment by the subject, whose activities pose the threat to the health of other persons, is required to provide health security.
