Summary/Abstract: The valid principle for establishment of an international criminal tribunal is nullum forum sine lege, which means that it can be established only under the corresponding international act. The notion "law", that is, "legal tribunal" in international criminal procedural law is observed here in the light of international contractual law, which is the way to reach the international criminal tribunal. The provisions of Article 29 of the United Nations Charter the Security Council refers to empowers the Security Council to establish subsidiary organs to take over measures under Articles 41 and 42 of the Charter, but such measures are taken only against the states, but not individuals. Therefore, establishment of the tribunal cannot be an enforcement measure for maintenance, that is, restoration of peace and security
