Summary/Abstract: The article deals with the recent judgment of the Supreme Court of 16 March 2021 file No. 15 Tdo 110/2021 which is of fundamental importance for application practice. The judgment concerns the very topical problem of the relation between the state of emergency and the fulfillment of the constituent element of the offence „during… another event seriously endangering lives or health of people, public order or property“ in the event of a covid-19 pandemic. The main goal of the work is the evaluation of the judgment and presenting a correct interpretation of that „endangering event“ by using methods of finding law. The problem solution is connected with the de lege ferenda proposals which are also submitted.
