Summary/Abstract: The article deals with the current decision of Constitutional Court of 26 May 2020 file No. Pl. ÚS 46/18. The judgment concerns the principle of subsidiarity of criminal repression too. The main goal of the work is just correct interpretation of this principle in regard to basic components of criminal liability. The methods of legal interpretation lead to conclusion that subsidiarity can be applied only within the scope of legal signs of crime.
