Summary/Abstract: The right to education is one of the human rights. According to the international and national law, everyone has the right to education. In the article the exercise of the right to education by foreigners living in Poland was analyzed. As a general rule , the nationality shall not be qualifying factor regarding the exercise of this right. Polish legal provisions regarding the right to education reflect the State’s international obligations. Every person living in Poland is obligated to attend school. That goes for the foreigners as well. However, on some level an access to education the national education system provided has not been the same for Polish citizens and foreigners. Many depends on the person’s citizenship.
