Summary/Abstract: The paper analyzes the provisions of the Law on Public Procurement that refer to the reasons for rejecting requests for participation or bids in public procurement procedures. The paper points out the shortcomings and insufficient precision of the current legal provisions of the topic, with a proposal to improve existing solutions, all in order to avoid difficulties in the process of evaluation and evaluation of bids in public procurement procedures, which often lead to (unnecessary) appeals and court proceedings.
